This document contains the terms and conditions that govern the use of this website and the contract that binds us (hereinafter the "Terms and Conditions").

1. INTRODUCTION

These Terms and Conditions establish the rights and obligations of all users (hereinafter "You"/"Your") and those of pulserasdeyoga.com (hereinafter "We"/"Our"/"the Seller") in relation to the items/services we offer through this website or any other website to which we may link (hereinafter collectively referred to as the "pulsadorasdeyoga.com Services").

Please read these Terms and Conditions and our Privacy Policy carefully before clicking "Authorize Payment" to place your order.

By using this website or placing an order through it, you agree to be bound by these Terms and Conditions and our Privacy Policy. Therefore, if you do not agree with all of the Terms and Conditions and the Privacy Policy, you should not place any order.

These Terms and Conditions may be modified, so please read them before placing each order.

2. USE OF OUR WEBSITE

These Terms and Conditions are the only terms and conditions applicable to the use of this website and supersede any other terms and conditions, except with the express prior written consent of the Seller.

These Terms and Conditions are important to both you and us as they are designed to create a legally binding agreement between us, protecting your rights as a customer and our rights as a company.

You declare that, by placing your order, you have read and unreservedly accept these Terms and Conditions.

You agree that:

a. You may not place any speculative, false, or fraudulent orders. If we have reasonable grounds to believe that such an order has been placed, we will be authorized to cancel it and inform the relevant authorities.

b. You also agree to provide us with your true and correct email address, postal address, and/or other contact information and agree that we may use this information to contact you if necessary (see our Privacy Policy).

c. If you do not provide us with all the information we require, we will not be able to process your order.

By placing an order through this website, you warrant that you are over 18 years of age and have the legal capacity to enter into binding contracts.

3. HOW IS THE CONTRACT FORMALIZED?

The information and details contained on this website do not constitute an offer to sell, but rather an invitation to do business.

No contract will exist between you and us in relation to any product until your order has been expressly accepted by us (even if your account has already been charged).

If your offer is not accepted and your account has already been charged, the amount will be refunded in full.

To place an order, you must follow the online checkout process and click "Authorize Payment." You will then receive an email acknowledging receipt of your order (the "Order Confirmation").

Please note that this does not mean that your order has been accepted, as it constitutes an offer from you to purchase one or more items. All orders are subject to our acceptance, and we will confirm such acceptance by sending you an email confirming that the product has been dispatched (the "Dispatch Confirmation").

The contract for the purchase of a product between us (the "Contract") will only be formed when we send you the Dispatch Confirmation.

Only those items listed in the Shipping Confirmation will be subject to the Contract.

We will not be obligated to supply any other products that may have been ordered until we confirm shipment of those items in a separate Shipping Confirmation.

4. AVAILABILITY OF ITEM(S)

All item orders are subject to availability. Therefore, if we are unable to receive your item(s) within 7 calendar days due to a lack of stock, except in the case of products made of pure gold, which is extended to 14 calendar days, or in the case of products using natural gemstones, which is extended to 28 calendar days, we will initially inform you of the estimated timeframe for the manufacture and shipment of your item.

We reserve the right to provide you with information about substitute items of equal or greater quality and value that you may order.

If you do not wish to order these replacement items or do not accept the estimated manufacturing and shipping date for your item, we will refund any amount you may have paid.

5.- LEGAL PRODUCT WARRANTY

Items on pulserasdeyoga.com are covered by a two-year legal warranty against non-conformity under the provisions of the General Law for the Defense of Consumers and Users.

Unless proven otherwise, the items will be deemed to be in compliance with the contract, and non-conformity will be deemed to be in compliance with the provisions of Article 116 of the General Law for the Defense of Consumers and Users.

Consumers may benefit from the legal warranty provided they can prove purchase of the product with proof of purchase.

Consumers have the right to free repair or replacement, under the same terms as those regulated for exchanges of defective items.

6.- REFUSAL TO PROCESS AN ORDER

We reserve the right to withdraw any Product from this website at any time and/or to remove or modify any material or content contained therein.

Although we will do our best to always process all orders, there may be exceptional circumstances that force us to refuse to process an order after we have sent the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion.

We will not be liable to you or any third party for removing any product from this website, regardless of whether that product has been sold, removing or modifying any materials or content on the website, or for refusing to process an order once we have sent you the Order Confirmation.

7. RIGHT TO WITHDRAW FROM THE PURCHASE

Although this is a personalized item, handcrafted to order, we offer you an extraordinary right of return as a buyer guarantee. You will have 7 calendar days to return the product if you do not like it. In this case, you will be responsible for the cost of the return, handling fees, and any financial collection fees (if any).

This extraordinary right of return does not apply to the Yogananda astrological bracelet and the Navaratna ring due to the high cost of the materials purchased for their manufacture.

In all other cases, this must be done with the original packaging and labeling, properly protected, and the product must be in perfect condition for use and preservation.

This right may be exercised by email to info@pulserasdeyoga.com, with the following text:

"I/we hereby inform you that I/we withdraw from my/our sales contract for the following item/– Ordered on/received on ..." Name of the consumer and user(s).
Address of the consumer and user(s).
Date.

Items that have been used, are damaged, or broken as a result of lack of care or negligence will not be accepted.

We will refund the amount paid less shipping costs, handling fees, and financial collection fees (if applicable) within 7 business days of receiving the purchase (or until such return is justified). The refund will be issued via the same method used by the customer.

To exchange an item, it must be sent in its original packaging to our center in Madrid, located at:

Shipping costs are the customer's responsibility.

8.- DELIVERY

Upon receiving your order, we will send you an email indicating the estimated production date in our workshop and the shipping date. We will also provide you with a tracking code for your package.

Notwithstanding the provisions of Clause 4 above, and unless extraordinary circumstances arise, we will endeavor to ship the order for the product(s) listed in the Shipping Confirmation within a maximum of 3 business days.

This delivery time may be delayed by up to 28 calendar days for any of the following reasons:

Personalization of items;
Special items;
Unforeseen circumstances;
Delivery area;

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to continue with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid.

Please note, in any case, that we do not deliver on Saturdays or Sundays.

For the purposes of these Terms and Conditions, "delivery" or the product(s) will be deemed to have occurred at the time of signing for receipt at the agreed delivery address.

9.- IMPOSSIBILITY OF DELIVERY

If we are unable to deliver, we will attempt to find a safe place to leave your package.

We will send you an email explaining where your package is (if we were able to find a safe place to leave it) or, if it has been returned to our warehouse, how to arrange for it to be sent back to you.

Please note that handling these returns and reshipping your product(s) may incur an additional cost, which you must pay.

If you do not agree to pay the handling and reshipping costs for your product(s), within 7 days of the return, we will refund the cost of the order less these handling costs.

10.- TRANSFER OF RISK AND OWNERSHIP

The risk of the ITEMS will be your responsibility from the moment of delivery.

You will acquire ownership of the items when we receive full payment of all amounts due in respect of them, including shipping costs, or upon delivery (as defined in clause 8), whichever is later.

11. PRICE AND PAYMENT

The price of the items will be as stipulated from time to time on our website, except in the case of obvious error.

The price displayed on the website corresponds to the final price.
If we discover an error in the price of the items you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.

If we are unable to contact you, the order will be deemed canceled, and you will be fully refunded.

Given the specifics of online purchasing, the price of the items indicated on the website refers solely and exclusively to purchases made on the website.

Accordingly, the price indicated on the website is only considered binding for online purchases.

We will not be obliged to supply the product(s) to you at the incorrect, lower price (even if we have sent you a Shipping Confirmation) if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as an incorrect price.

The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due as set out on our "Shipping Costs" page.

Prices may change at any time, but (except as set out above) any changes will not affect orders for which we have already sent you a Shipping Confirmation.

Once you've completed your purchase, all the items you wish to purchase will have been added to your shopping bag, and the next step is to process the order and make the payment.

To do this:

1. Click the "My Cart" button at the top of the page.
2. Click the "Checkout" button.
3. Fill in or verify your contact information, order details, the address you wish to ship the order to, and the address to which the invoice should be sent. Click the "Continue to Shipping Method" button.
4. Select the shipping method. Click the "Continue to Payment Method" button.
5. Choose the payment method you wish to use and enter the corresponding information.
6. Accept the "Terms and Conditions."
7. Click "Checkout."

You can pay by card using the Shopify payment platform. To minimize the risk of unauthorized access, all our credit/debit card transactions are processed through Shopify's secure platform.

Payment must be authorized at the time of order processing. The total order amount will be debited once you confirm your purchase and have accessed the payment gateway linked to your bank.

By clicking "Authorize Payment," you confirm that the credit card is yours.

Credit cards are subject to verification and authorization by the card issuer. However, if the card issuer does not authorize payment, we will not be liable for any delay or non-delivery, and we will not be able to enter into any contract with you.

You can also pay using cryptocurrency (Bitcoin, Bitcoin Cash, Ethereum, or LiteCoin) from Coinbase, or any other cryptocurrency by contacting us.

12. VALUE ADDED TAX

In accordance with current regulations, all purchases made through the Website will be subject to Value Added Tax (VAT), which will be charged at the rate in effect at the time of delivery.

12.1. TAXES AT DESTINATION

For sales outside of Spain, the buyer will be responsible for paying taxes and duties upon arrival of the product in the country indicated.

If the item is returned to its origin, the buyer must determine another valid delivery address in another location, and additional costs may apply.

13.- RETURN POLICY

13.1.- GENERAL RULES FOR WITHDRAWAL AND RETURN

The customer has the right to withdraw from the contract under the terms set forth in the Consolidated Text of the General Law for the Defense of Consumers and Users within fourteen calendar days of receiving the item.

Since this is a personalized product, handcrafted upon request, withdrawal does not apply. Therefore, we offer you an extraordinary right of return, as a consumer guarantee, which must be exercised within 7 calendar days of entering into the contract.

This extraordinary right of return does not apply to the Yogananda astrological bracelet and the Navaratna ring due to the high cost of the materials purchased for their manufacture.

In all other cases, please send your product in its original packaging, in perfect, unused condition, to:

Within the indicated period, including a communication stating your intention to make an extraordinary return, including your details and the details of the contract for which you intend to make an extraordinary return, or, if applicable, a return form indicating your intention to make an extraordinary return of the product, with the return costs being borne by the customer.

Once the extraordinary return has been formalized and the item has been returned along with its original packaging, the refund will be processed as soon as possible, and in any case, within 7 business days of the item being returned to our facilities.

You will be refunded the price paid for the product less return shipping costs (shipping, handling fees, and any financial fees), using the same payment method used by the customer for the initial transaction.

13.2.- GENERAL RULES FOR EXCHANGES

Exchanges are only possible for an item of equal or greater value, paying the price difference, within the first 7 days of receiving the item.

Without prejudice to the right to extraordinary returns, purchases are not refundable except in the case of defects or damage. However, before sending an item, it is carefully photographed and inspected to avoid such circumstances.

Please note that since these are handcrafted products, each one has its own characteristics due to the metalwork.

If you wish to exchange an item, you must send it to the following address along with its original packaging. Shipping costs will always be borne by the customer. We recommend shipping via a courier company due to the type of product. The item will be shipped at the customer's expense and responsibility until it is received at our facilities.

Exchanges of items with freight collect will not be accepted. The shipping address for exchanges is as follows:

You must send the product to the address indicated above, stating the reason for the exchange, along with proof of purchase, and requesting a repair or replacement. This return will be completely free of charge.

We will carefully examine the product and will notify you by email within a reasonable time if a replacement is appropriate (if applicable) and the expected delivery date of the new product chosen (if applicable).

All rights recognized by current legislation are subject to change.

14. LIABILITY AND DISCLAIMER OF LIABILITY

Our liability in connection with any Product purchased on our website shall be strictly limited to the purchase price of that Product.

Nothing in these Purchase Conditions excludes or limits our liability in any way:

a. In the event of death or personal injury caused by our negligence;
b. In the event of fraud or fraudulent misrepresentation;
c. In any matter where it would be illegal or unlawful for us to exclude, limit, or attempt to exclude or limit our liability.

Notwithstanding the provisions of the preceding paragraph and to the extent permitted by law, and except as otherwise provided in these Conditions, we will not accept any liability for indirect damages arising as a side effect of the main loss or damage, however arising, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable, including but not limited to the following:

i. loss of income or sales;
ii. loss of business;
iii. loss of profits or loss of contracts;
iv. loss of anticipated savings;
v. loss of data;
and vi. loss of management or office time.

Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not warrant the accuracy and security of any information transmitted or obtained through this website unless expressly stated otherwise.

All descriptions of items, information, and materials appearing on this website are provided "as is" and without warranties, express, implied, or otherwise.
To the extent permitted by law, we exclude all warranties, except for those that cannot lawfully be excluded for consumers.

The items we sell, especially items made of precious metals, may often have particular characteristics due to their artisanal production process.

These characteristics will not be considered defects or flaws. On the contrary, their presence should be expected and appreciated.

We only select precious metal grains of the highest quality and purity (99.9%), but particular characteristics are unavoidable and must be accepted as part of the individual appearance of the product.

The provisions of this clause will not affect your statutory rights as a consumer, nor your right to withdraw from the Contract.

15. INTELLECTUAL PROPERTY

You acknowledge and agree that all copyright, trademarks, and other intellectual property rights in the materials or content provided as part of the Website remain at all times vested in us or those who have licensed their use to us.

You may use such material only as expressly authorized by us or our licensors. This will not prevent you from using this website to the extent necessary to copy information about your order or contact information.

16. WRITTEN COMMUNICATIONS

Applicable regulations require that some of the information or communications we send you be in writing.

By using this website, you agree that most communications with us will be electronic.

We will contact you by email or provide information by posting notices on this website.

For contractual purposes, you consent to the use of this electronic means of communication and acknowledge that all contracts, notices, information, and other communications we send you electronically comply with the legal requirements of being in writing.

This condition will not affect your statutory rights.

17.- NOTIFICATIONS

Your notifications should preferably be sent through our contact form.

In accordance with the provisions of clause 16 and unless otherwise stipulated, we may send communications to you either by email or to the postal address provided by you when placing an order.

Notifications will be deemed to have been received and properly served immediately upon posting on our website, 24 hours after an email is sent, or three days after the postage date of any letter.

To prove that notification has been served, it will be sufficient to prove, in the case of a letter, that it was correctly addressed, properly stamped, and duly delivered to the post office or postbox, and, in the case of an email, that it was sent to the email address specified by the recipient.

18. ASSIGNMENT OF RIGHTS AND OBLIGATIONS

The Contract between you and us is binding on both you and us, as well as on our respective successors, assignees, and assignees.

You may not transfer, assign, encumber, or otherwise transfer a Contract or any of the rights or obligations arising from it to you or us without obtaining our prior written consent.

We may transfer, assign, encumber, subcontract, or otherwise transfer a Contract or any of the rights or obligations arising from it to us or us at any time during the term of the Contract.

For the avoidance of doubt, such transfers, assignments, encumbrances, or other transfers will not affect your statutory rights as consumers or invalidate, reduce, or otherwise limit any warranties, whether express or implied, that we may have granted you.

19. EVENTS OUTSIDE OUR CONTROL

We will not be liable for any failure to perform, or delay in the performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event").

Force Majeure Events shall include any act, event, failure to perform, omission, or accident beyond our reasonable control and shall include in particular (without limitation) the following:

a. Strikes, lockouts, or other industrial action.
b. Civil commotion, riot, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
d. Impossibility of using trains, ships, aircraft, motor transport, or other means of transport, whether public or private. e. Inability to use public or private telecommunications systems.
f. Acts, decrees, legislation, regulations, or restrictions of other governments.
g. Strikes, failures, or accidents involving maritime, river, postal, or any other type of transportation. Our obligation to perform under any Contract will be deemed suspended for the period in which the Force Majeure Event continues, and we will have an extension of time to perform our obligation for the duration of that period. We will use all reasonable efforts to bring the Force Majeure Event to an end or to find a solution by which we can perform our obligations under the Contract despite the Force Majeure Event.

20. WAIVER

If, during the term of a Contract, we fail to insist upon strict performance of any of the obligations assumed under the Contract or any of these Terms and Conditions, or if we fail to exercise any of the rights or remedies that we are entitled to exercise or pursue under the Contract or these Terms and Conditions, this will not constitute a waiver of those rights or remedies nor will it relieve you from compliance with those obligations.

Any waiver by us of any requirement for performance will not constitute a waiver by us of any subsequent requirement for performance.

No waiver by us of any of these Terms and Conditions will be effective unless it is expressly stated to be a waiver and communicated to you in writing in accordance with the Notices section above.

21.- SEVERABILITY

If any of these Conditions or any provision of a Contract are deemed invalid, illegal, or unenforceable to any extent by a competent authority, they shall be severed from the remaining Conditions, conditions, and provisions, which shall continue to be valid to the fullest extent permitted by law.

22.- ENTIRE CONTRACT

These Conditions and any document expressly referred to in them constitute the entire agreement between you and us in relation to the subject matter of this Contract and supersede any prior agreement, understanding, or arrangement made between you and us, whether oral or in writing.

You and we acknowledge that you have agreed to enter into this Contract without relying on any representation or promise made by the other party or that could be inferred from any statement or writing in the negotiations between us prior to this Contract, except as expressly mentioned in these Conditions.

Neither you nor we will have any recourse against any untrue statements made by the other party, whether oral or written, prior to the date of the Contract (unless such untrue statements were made fraudulently), and the other party's sole remedy will be for breach of contract in accordance with these Terms and Conditions.

23. OUR RIGHT TO MODIFY THESE TERMS AND CONDITIONS

We have the right to review and modify these Terms and Conditions at any time.

You will be subject to the policies and Conditions in force at the time you place each order, unless we are required by law or by a government agency to make changes to these policies, Conditions, or the Privacy Statement, in which case any changes will also affect orders you have previously placed.

24. APPLICABLE LAW AND JURISDICTION

These General Conditions are governed by Spanish law: twistedyogabangles.com and the user, expressly waiving any other jurisdiction, submit to the jurisdiction of the Courts and Tribunals of the service provider's domicile for any dispute that may arise from the provision of the services covered by these General Conditions.

25. COMMENTS AND SUGGESTIONS

Your comments and suggestions are welcome. We ask that you send them to us through our "Contact Form."

There are several simple precautions that can extend the life of your jewelry.

For example: we suggest that if your yoga bracelet gets wet, you dry it thoroughly. Try to avoid contact of your jewelry with cosmetics and/or household items, as they sometimes contain ingredients that can damage the color of your jewelry. To clean your jewelry, soak it in warm soapy water for a few minutes. Make sure it's a pH-neutral soap. Scrub gently with a soft toothbrush. Rinse gently with warm water and then dry with a chamois leather or a soft cloth. Do not expose your jewelry to sudden temperature changes. If you're not wearing it, for proper storage, it's best to store your items individually in their original pouch and case, as these are designed to protect your jewelry. If you choose to store it in a jewelry box, try to keep it in a separate compartment from other pieces.
